Terms & Conditions
BY SIGNING UP FOR 80SPHONE YOU ACCEPT THESE TERMS. ANY OF THE FOLLOWING CONSTITUTES ACCEPTANCE: (1) CREATING AN ACCOUNT, (2) COMPLETING KYC VERIFICATION, (3) USING THE SERVICES.
1. Introduction
These Terms and Conditions (the "Agreement") constitute the entire agreement between Abdulrakeeb Enterprises ("80sPhone," "we," "us") and the individual registering for or using 80sPhone's services ("you," "User," "Customer"). This Agreement governs your access to and use of 80sPhone's dedicated U.S. virtual phone number services, messaging, calling features, and associated platform.
2. Definitions
"Services" means the dedicated U.S. virtual phone number, browser-based calling and messaging, KYC verification, and all associated platform features provided by 80sPhone.
"User" means any individual who registers for, contracts for, or uses 80sPhone's Services.
"Recipient" means any individual who receives calls or messages from a User through their 80sPhone virtual number, having given explicit consent.
"KYC" means the Know Your Customer identity verification process required before a virtual number is assigned.
"Number" means the dedicated U.S. virtual phone number assigned to a User upon successful KYC approval.
3. Eligibility and Account Registration
You must be at least 18 years of age to register for 80sPhone. By creating an account, you confirm that all information provided is accurate and complete. 80sPhone serves freelancers and remote professionals located outside the United States, including but not limited to Nigeria and other African countries, who require a U.S. virtual number for legitimate professional communication.
You are responsible for maintaining the security of your account credentials. You agree to notify 80sPhone immediately of any unauthorized use of your account.
4. KYC Verification
All Users must complete KYC identity verification before a Number is assigned and before any messaging or calling access is enabled. Number assignment and platform access are strictly conditional on successful KYC approval. 80sPhone reserves the right to deny or revoke approval at its sole discretion if verification requirements are not met or if false information is submitted.
5. Permitted Use
80sPhone's Services are provided exclusively for lawful, one-to-one professional communication between a User and their clients, customers, or contacts. Permitted uses include:
- Customer communication and professional client messaging
- Personal professional communication using a dedicated work number
- Receiving and making calls via your assigned U.S. virtual number
You agree to use the Services in compliance with all applicable laws and regulations, including U.S. telecommunications regulations, TCPA, and A2P 10DLC requirements. You are solely responsible for obtaining proper consent from Recipients before sending any message.
6. Prohibited Use
The following are strictly prohibited and will result in immediate account suspension or termination:
- Marketing campaigns, bulk SMS, or mass messaging of any kind
- Cold outreach to individuals who have not provided explicit consent
- Use of purchased contact lists or third-party recipient databases
- Spam, phishing, smishing, fraud, or impersonation
- Sending illegal content or content prohibited under CTIA guidelines
- Reselling or transferring your Number or account to another party
- Using the Services to harass, threaten, or abuse any individual
- Any use that violates 80sPhone's Acceptable Use Policy
7. Consent Requirements
You are solely responsible for ensuring that all Recipients have provided explicit, documented consent before you send them any message through your 80sPhone Number. 80sPhone provides a consent capture tool for this purpose. You must not message any Recipient who has not opted in through a compliant consent process. Recipients may opt out at any time by replying STOP, which must be honored immediately.
8. Number Assignment and Lifecycle
Upon successful KYC approval, 80sPhone will assign you a dedicated U.S. virtual number for a 12-month term. Your number will remain active as long as your subscription is current and renewal requirements are met. Numbers may be released after unresolved expiry or account termination. 80sPhone does not guarantee the return of a previously held number once released.
9. Term, Renewal, and Cancellation
Your subscription begins on the date of your first payment and runs for 12 months. Subscriptions auto-renew annually unless you cancel before the end of the current term. To cancel, contact support@80sphone.com before your renewal date. No refunds are issued after activation. Please refer to the Billing and Refund Policy for full details.
10. Changes to Terms
80sPhone reserves the right to update these Terms at any time. Updated terms will be posted to www.80sphone.com and are effective upon posting. Continued use of the Services after changes are posted constitutes acceptance of the revised terms.
11. Limitation of Liability
80sPhone provides its Services "as is" and makes no express or implied warranties regarding uninterrupted service, call quality, or message delivery. To the fullest extent permitted by law, 80sPhone's total liability for any claim arising from use of the Services shall not exceed the subscription fees paid by you in the 12 months preceding the claim.
80sPhone is not liable for any indirect, incidental, consequential, or punitive damages arising from your use or inability to use the Services.
12. Indemnification
You agree to defend, indemnify, and hold harmless 80sPhone and Abdulrakeeb Enterprises from any claims, damages, liabilities, fines, or expenses, including legal fees, arising from your use of the Services, your violation of these Terms, or your violation of any applicable law or third-party right.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law provisions. Any disputes arising from this Agreement shall be resolved through good-faith negotiation. If unresolved, disputes shall be referred to binding arbitration.
