Privacy Policy

80sPhone is a communications platform providing dedicated U.S. virtual phone numbers to freelancers and remote professionals. 80sPhone is operated by Abdulrakeeb Enterprises ("80sPhone"). This Privacy Policy sets forth details regarding the information 80sPhone collects from its Users and Recipients, and from those who visit our website (www.80sphone.com).

Definitions

As used in this Privacy Policy, the below terms have the following meanings:

"Applicable Law" means the applicable laws and regulations which govern the collection, use, and administration of Personal Data, including telecommunications regulations applicable to A2P messaging.

"Data Subject" is any 80sPhone User or Recipient whose Personal Data is processed by 80sPhone.

"Personal Data" is information relating to an identified or identifiable natural person. Examples include a name, phone number, identification number, contact information, location data, and an online identifier.

"Personal Data Breach" means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, Personal Data transmitted, stored, or otherwise processed.

"Process" means any operation or set of operations performed on Personal Data, such as collecting, using, storing, sharing, and destroying Personal Data.

"Recipient" is any individual who receives calls or messages from a User through 80sPhone's dedicated virtual number services, and who has provided explicit consent to be contacted through the platform.

"User" is any individual who inquires about, contracts for, and/or uses 80sPhone's virtual number and communications services, or who visits 80sPhone's website or uses 80sPhone products or services.

The Information We Collect

In most cases, 80sPhone collects Personal Data directly from the User. When you register for 80sPhone's services, we collect the following:

  • Full name and legal identity information
  • Government-issued identification document for KYC verification
  • Contact information including email address and phone number
  • Business or professional details provided during onboarding
  • Billing and payment information
  • Device and browser information for account security purposes

When you submit a support request, we ask for your name, email address, contact phone number, and your 80sPhone account details, as well as the details of your issue or request.

80sPhone also collects consent records from Recipients, the clients and customers of our Users, as described in the section below.

How We Collect and Use Recipient Consent

Before any User may send an SMS message or make a call to a Recipient through their 80sPhone virtual number, 80sPhone requires that explicit consent be obtained from that Recipient. This is a core requirement of A2P 10DLC telecommunications compliance.

Recipient consent is collected through a dedicated opt-in form made available by 80sPhone. The consent form collects the following information from the Recipient:

  • Full name
  • Phone number
  • Email address, optional
  • Explicit opt-in confirmation via an unchecked checkbox
  • Date and time of consent submission

The consent form presented to Recipients includes the following disclosure:

I agree to receive SMS messages from 80sPhone on behalf of the person or business that invited me. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out at any time. Reply HELP for assistance.

Recipient consent records are stored securely and linked to the User account that initiated the invitation. No message may be sent to a Recipient until a valid consent record exists. Recipients may withdraw consent at any time by replying STOP, which is processed immediately and permanently.

No Recipient consent data or opt-in information is shared with any third party for marketing or promotional purposes. All text messaging originator opt-in data and consent records are excluded from any third-party data sharing arrangements.

KYC Verification

80sPhone requires all Users to complete a Know Your Customer (KYC) verification process before a dedicated virtual number is assigned and before any messaging or calling access is enabled. KYC verification is conducted to reduce abuse risk and to ensure that 80sPhone's services are used only by identifiable, approved individuals.

KYC information collected includes government-issued identification and may include additional identity verification documents as required. This information is processed solely for verification purposes and is retained in accordance with applicable legal requirements.

Why We Process and How We Use Personal Data

80sPhone processes your Personal Data at your request and with your consent to allow you to determine whether to contract for our services, and to allow us to administer your account and respond to your inquiries. We may use your Personal Data for the following legitimate purposes:

  • To provide, administer, and maintain your 80sPhone account and virtual number
  • To conduct KYC identity verification
  • To collect and store Recipient consent records in compliance with A2P 10DLC requirements
  • To enforce platform rules, including anti-spam and acceptable use policies
  • To process billing and payments
  • To respond to support requests and account inquiries
  • To protect against and identify fraud, abuse, and other prohibited activity
  • For internal recordkeeping, audits, and legal compliance
  • To exercise or defend against legal claims

You are under no statutory or contractual obligation to provide Personal Data to 80sPhone. However, if you do not provide certain information, we may not be able to activate your account or assign a virtual number.

With Whom We Share Personal Data

80sPhone employees: Your Personal Data is shared internally among 80sPhone personnel as appropriate to allow us to serve your account needs and respond to your requests.

Service providers: We may share your information with trusted service providers who assist us in operating the platform, including hosting, payment processing, identity verification, and telecommunications infrastructure. These providers are required to protect your information in the same manner as 80sPhone and may not use it for any other purpose.

Law enforcement: We may share your Personal Data with law enforcement or other government entities if required by law, if we believe there has been a violation of our Terms and Conditions, or to respond to judicial process.

Corporate restructuring: In the event of a merger, acquisition, or asset sale, your Personal Data may be transferred. We will use reasonable efforts to inform you of any such transfer.

80sPhone does not sell or share Personal Data with third parties for marketing purposes. No mobile or messaging consent information will be shared with third parties or affiliates for marketing or promotional purposes. All text messaging originator opt-in data and consent records are excluded from any third-party sharing arrangements.

How We Protect Your Personal Data

80sPhone takes the security of your data seriously. We have established electronic and administrative safeguards, including data encryption and restricted personnel access, designed to protect the Personal Data we collect, prevent unauthorized access, and ensure it is used appropriately.

Although we strive to keep your Personal Data secure, no security measures are absolute. We will make reasonable attempts to notify you if we determine that 80sPhone has experienced a Personal Data Breach, unless we are not required to do so under Applicable Law.

Where We Store and How Long We Retain Personal Data

Your Personal Data will be stored in 80sPhone's secure IT systems. 80sPhone will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy, or as required to comply with applicable legal obligations, resolve disputes, and enforce our agreements.

Recipient consent records are retained for as long as the User's account remains active or as required by telecommunications compliance obligations. Upon a Recipient's opt-out, their consent withdrawal is recorded immediately and no further messages are permitted.

Children's Data

80sPhone does not knowingly process the Personal Data of anyone under the age of 18 without parental consent.
