Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs all use of 80sPhone's virtual number and communications platform. By using 80sPhone, you agree to comply with this AUP at all times. Violations may result in immediate suspension or permanent termination of your account without refund.
1. Purpose
80sPhone provides dedicated U.S. virtual phone numbers exclusively for lawful, consent-based, one-to-one professional communication. This AUP exists to protect Recipients, maintain platform integrity, and ensure compliance with U.S. carrier regulations including A2P 10DLC requirements enforced by The Campaign Registry (TCR) and mobile carriers including T-Mobile, AT&T, and Verizon.
2. Permitted Use
You may use your 80sPhone Number only for the following purposes:
- Direct, one-to-one professional communication with clients or customers who have given explicit consent
- Sending and receiving messages related to your freelance work, services, or professional activities
- Making and receiving calls using your dedicated U.S. virtual number
- Account-related notifications and responses to inbound customer inquiries
3. Prohibited Content and Use
The following are strictly prohibited on the 80sPhone platform:
Spam and Bulk Messaging: Sending unsolicited messages, bulk SMS, broadcast messaging, or mass outreach of any kind is prohibited. Each message must be sent to a Recipient who has explicitly consented to receive communications from you.
Cold Outreach: Contacting individuals who have not provided explicit, documented opt-in consent is prohibited regardless of how their contact information was obtained.
Purchased Lists: Using purchased, rented, or third-party contact lists as Recipients is prohibited.
Marketing Campaigns: Using your Number for promotional campaigns, advertising, discount offers, or any form of mass marketing is not permitted.
Illegal Content: Sending content that is illegal under U.S. federal law or applicable local laws, including but not limited to SHAFT content (sex, hate, alcohol, firearms, tobacco) that does not comply with applicable regulations.
Phishing and Fraud: Sending messages designed to deceive, impersonate another entity, or obtain personal information under false pretenses is strictly prohibited and may result in carrier fines being passed to your account.
Harassment: Using the platform to threaten, harass, or abuse any individual.
Impersonation: Representing yourself as another individual, organization, or government entity.
Number Resale: Reselling, subleasing, or transferring your assigned Number to any third party.
4. Consent Requirements
Before sending any message to a Recipient, you must ensure that:
- The Recipient has explicitly opted in to receive messages from you via a compliant consent form
- The consent was not a condition of any purchase or service
- The Recipient was informed of message frequency, data rates, and opt-out instructions at the time of consent
- A valid consent record exists in your 80sPhone account linked to that Recipient
80sPhone provides a consent capture tool for this purpose. You must use this tool or an equivalent compliant mechanism and retain consent records. Failure to maintain valid consent records is a violation of this AUP.
5. Opt-Out Compliance
You must honor all opt-out requests immediately. When a Recipient replies STOP, CANCEL, or any similar opt-out keyword, no further messages may be sent to that Recipient. 80sPhone enforces opt-out compliance automatically at the platform level. You may not attempt to re-contact a Recipient who has opted out without a new, independent opt-in.
6. Carrier Compliance
All messaging activity on 80sPhone is subject to U.S. carrier regulations and A2P 10DLC requirements. Violations of carrier rules may result in message blocking, carrier fines, or campaign suspension. 80sPhone reserves the right to pass on any carrier-imposed fines to the User whose activity caused the violation, including:
- Tier 1 - Phishing, smishing, social engineering: up to $2,000 per violation
- Tier 2 - Illegal content: up to $1,000 per violation
- Tier 3 - Other violations including non-compliant content: up to $500 per violation
7. Enforcement
80sPhone monitors platform activity for AUP compliance. Upon detecting a violation, 80sPhone may take any of the following actions at its sole discretion:
- Issue a written warning
- Temporarily suspend your account and Number
- Permanently terminate your account without refund
- Report the violation to relevant carriers, regulatory bodies, or law enforcement
- Pass on any carrier-imposed fines to your account
8. Reporting Abuse
To report abuse or suspected violations, contact 80sPhone at admin@80sphone.com. All abuse reports are reviewed and acted upon in accordance with this AUP.
9. Updates to This Policy
This AUP may be updated at any time to reflect changes in carrier requirements, regulations, or platform policies. Updated versions will be posted to www.80sphone.com. Continued use of the Services constitutes acceptance of the revised AUP.
